Effective Date: October 22, 2026 · Last Updated: October 22, 2026
Effective October 22, 2026. This Policy applies to the iCAN-branded hub operated by Proseek LLC for Identity Creative Arts Network, LLC (iCAN). Version 2, incorporating iCAN review.
This Privacy Policy describes how Proseek LLC ("Proseek," "we," "us," or "our") collects, uses, shares, and protects information in connection with the iCAN Partner Hub (the "Hub"), a branded marketplace operated on the Proseek platform for Identity Creative Arts Network ("iCAN"), including the Hub website and all related services (collectively, the "Service").
The Hub connects marching arts professionals ("Professionals") with directors, educators, programs, ensembles, and performers ("Clients") for video review, show and program review, live consultation, design and project services, and clinics and masterclasses. By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree, please do not use the Service.
This Privacy Policy applies to Professionals who offer services through the Hub; Clients, including the adults who hold accounts on behalf of students under 18; and visitors to the Hub website. iCAN administers the Hub and has access to certain information as described in Section 4.6; iCAN's websites and communications outside the Hub are managed separately from the Service and may be subject to separate privacy notices.
2.1 Information you provide
2.2 Information collected automatically
2.3 Information from third parties. When you connect an external service, we receive information from it as authorized by you, for example Google Calendar connection tokens and availability details used to sync your availability, sign-in profile information from Apple or Google, and payout and verification status from Stripe.
We do not sell personal information, and we do not use your information for cross-context behavioral advertising.
4.1 With other users. The Hub is a marketplace, so some information is shared by design. A Professional's public profile (name, photo, bio, disciplines, services, pricing, credentials, and reviews where enabled) is visible to other users and may be publicly visible. When an order or booking is made, the Professional and Client each see the information needed to deliver the service (such as name, school or program if provided, order details, submitted materials, and messages exchanged). Materials submitted for review or design are private to the Client, the Professional, and Hub administrators where needed to resolve a dispute; they are not published. Reviews you post are attributed to you.
4.2 Service providers. We share information with third-party providers who help us operate the Service, each bound by contract to protect your information and use it only as we direct: Supabase (application database, authentication, file storage, and infrastructure); Stripe (payment processing, Professional payout accounts, and identity verification for payouts); Twilio (SMS messaging and A2P 10DLC compliance); Flowpilot360 (CRM, messaging, and scheduling platform used to operate client communications); LiveKit (live video sessions, clinics, and masterclasses); Amazon Web Services (cloud storage and hosting, including recordings and uploaded media); Vercel (web application hosting and content delivery); Google (calendar availability sync and sign-in); Apple and Google (sign-in); Sentry (error monitoring and application performance diagnostics); and our email delivery provider (transactional email).
4.3 Legal requirements and safety. We may disclose information if we believe in good faith that disclosure is necessary to comply with applicable law, legal process, or a governmental request; to enforce our Terms of Service; to detect, prevent, or address fraud, security, or technical issues; or to protect the rights, property, or safety of Proseek, iCAN, our users, or the public.
4.4 Business transfers. If Proseek is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or control.
4.5 Aggregated or de-identified information. We may share aggregated or de-identified information that cannot reasonably be used to identify you.
4.6 With iCAN, the Hub partner. iCAN administers the Hub. Authorized iCAN administrators can see Professional applications and profiles, Client account names and schools or programs, order and booking records and their status, reviews and reports, and read-only payout summaries, in order to approve and manage Professionals, feature profiles, moderate content, resolve disputes, initiate refunds, and support users. iCAN does not have access to your password, full payment card numbers, or payout banking credentials. iCAN may use Hub information to administer, support, and promote the Hub, including sending Hub communications to Professionals and Clients, subject to applicable privacy requirements and your communication preferences. iCAN is contractually required to protect confidential information and may not sell personal information. Materials submitted for review or design are accessible to iCAN administrators only where needed to resolve a dispute.
Live consultations, clinics, and masterclasses conducted online are delivered through our real-time video provider (LiveKit). Where a session or event is recorded, that is indicated in the Service; recordings are stored with our cloud storage provider (Amazon Web Services) and made available to the participants entitled to them. Performance videos, audio, scores, drill, and other media you upload are stored with our storage providers in private storage and are accessible only to the parties to the order and to administrators where permitted. Please do not share sensitive personal information in public areas of the Service. Additional terms about recordings, submitted materials, and likeness are in the Terms of Service.
Authorized iCAN administrators (for the Hub) and Proseek administrators (for the platform) may review account, profile, order, and reported content in order to approve Professionals, feature profiles, moderate content, investigate reports and disputes, and suspend accounts that violate the terms. Administrative actions are logged. Administrators do not have access to your password or to payout banking credentials, which are held by our authentication and payment providers.
We retain information for as long as your account is active or as needed to provide the Service. After account closure, we retain transaction, payout, and tax records as required by law (generally up to 7 years), retain records needed to resolve disputes or enforce our agreements, retain anonymized or aggregated usage analytics, and delete other personal information within 90 days unless longer retention is required by law. Submitted materials and delivered feedback, including materials involving Minor Participants, are retained while your account is active so you can refer back to them, and you may delete your own uploads at any time; when an account is closed they are deleted on the schedule above, and transaction records are kept. Submitted materials are never used to train artificial intelligence or machine learning models. Records evidencing SMS consent and opt-out are retained as required for messaging-compliance purposes. You may request earlier deletion of specific information by contacting ops@proseek.org.
Depending on your location, you may have rights to access, correct, delete, or port your personal information; to object to or restrict certain processing; to withdraw consent; and to lodge a complaint with a data protection authority. To exercise these rights, contact ops@proseek.org with the subject line "Privacy Rights Request." We will verify your request before acting on it. A parent or guardian may exercise these rights for a Minor Participant's information, and a school or program may do so for information it submitted on a student's behalf.
Your choices: SMS, reply STOP, STOPALL, UNSUBSCRIBE, END, QUIT, or CANCEL to opt out at any time, and reply HELP for help. Email, use the unsubscribe link in non-transactional email; we will still send essential account, order, and security messages. Calendar, disconnect Google Calendar at any time in your settings. Account, request deletion of your account by contacting us.
California residents: under the California Consumer Privacy Act (CCPA/CPRA), you have the right to know, the right to delete, the right to correct, the right to opt out of sale or sharing, and the right to non-discrimination for exercising your rights. We do not sell or share personal information as those terms are defined under California law.
The Service is hosted in the United States and operated for users in the United States. If you access the Service from outside the United States, your information will be transferred to and processed in the United States, which may have different data-protection laws than your country. By using the Service, you consent to that transfer and processing, subject to applicable law.
No mobile information, including mobile phone numbers, SMS opt-in data, or SMS consent, is shared with, sold to, or rented to any third parties or affiliates for marketing or promotional purposes. Mobile opt-in information and consent are disclosed only to the service providers that operate our messaging on our behalf (our CRM and messaging platform provider, Flowpilot360, and our SMS infrastructure provider, Twilio) and the mobile carriers strictly necessary to transmit those messages, and to no one else.
When you provide your mobile number and consent to receive SMS: your consent is optional, is never pre-checked, and is not a condition of purchase or of receiving any service; you may receive SMS about your orders, bookings, sessions, clinics and events, reminders, delivery notices, replies to your inquiries, and occasional account updates; your phone number, message content, delivery status, and reply content are processed through Flowpilot360, Twilio, and the mobile carriers necessary to deliver the messages; we retain SMS records to provide messaging history and to maintain proof of consent (the wording you agreed to, the date and time, and the originating IP address); you can opt out at any time by replying STOP, and we honor opt-out requests by adding your number to a suppression list; and we do not share end-user phone numbers or SMS content with third parties for marketing purposes. Full program details are in our SMS Terms.
We implement reasonable technical and organizational measures designed to protect your information, including encryption of data in transit (TLS) and at rest, row-level access controls that restrict data access to authorized accounts, signed, expiring links for submitted media, role-based administrative permissions, audit logging, and ongoing security practices appropriate to the Service. If a security incident affects Hub users, Proseek will notify iCAN promptly after confirming it so that users can be informed, in addition to any notice required by law. No method of transmission or storage is 100% secure; while we strive to protect your information, we cannot guarantee absolute security. If we become aware of a security incident affecting your information, we will notify you as required by applicable law.
We use cookies and similar technologies to authenticate users and maintain session state, remember preferences, understand and improve usage of the Service, and detect and prevent fraud. You can control cookies through your browser settings; disabling them may limit functionality. We do not use cookies for cross-site behavioral advertising.
Accounts on the Hub are for adults 18 and older, and we do not knowingly collect personal information directly from anyone under 18. The Hub does serve students under 18 through the adults responsible for them. Information about a student under 18 (a "Minor Participant"), such as a performance video or a first name, is provided to us by a parent or legal guardian or by an authorized adult at the student's school or program, who is responsible for having the consent needed to share it. We use that information only to provide the requested service; it is not published and is not used for marketing without separate authorization and any additional permissions required by law, as described in the Terms of Service. We do not knowingly collect personal information directly from children under 13. A parent or guardian may review, correct, or request deletion of a Minor Participant's information by contacting ops@proseek.org. If you believe a minor has created an account or provided us information directly, contact ops@proseek.org and we will delete the information and close the account.
Performance videos, recordings, scores, drill, and notes you submit are shared with the Professional you ordered from in order to deliver the service. They may include the images and voices of students and other performers, and they may include copyrighted music, scores, drill, or choreography licensed to your program. Submit only material you have the right to share, and avoid including unnecessary medical, disability-related, or other sensitive personal information about performers in your submissions or notes. Proseek is not a healthcare provider and is not a covered entity under HIPAA.
The Service may contain links to third-party websites or services, including iCAN's own website. This Privacy Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party services you visit.
We may update this Privacy Policy from time to time. When we make changes, we will update the effective date above. For material changes, we will provide more prominent notice, and where required by applicable law we will obtain your consent before changing how your personal information is used. Your continued use of the Service after an update constitutes acceptance of the updated policy.
